The following terms and conditions apply to all transactions on fireplaces4life.co.uk. The use of this site indicates your acceptance of these terms and conditions. The placement of an order also indicates your acceptance of these terms and conditions. These terms and conditions also extend to cover mail order sales not sold via the website. We recommend that you read them carefully and print a copy for future reference.
These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age and accept delivery within the UK. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.
Any links from this site to other web sites have been included for you convenience only. However the inclusion of a link does not imply that we endorse any responsibility for the linked site, its content or provider. Access to a linked site will be subject to that sites own terms and conditions to which you should refer.
Please note mail order, telephone and internet sales to individuals (this does not include businesses) are covered by the Consumer Protection (Distance Selling) Regulations 2000 (UK Law Directive 97/7/EC), which protect you by providing a 7 working day cooling off period after the day after the product has been delivered. A customer has the option to cancel any order between the time of placing it and 7 working days after delivery. Cancellations must be in writing by post or by email to email@example.com (this can not be to ANY other email address) and quoting the Order Number. Under the Distance Selling regulations you have the right to receive a refund within 30 days of cancellation. We will always try to pay refunds within 14 working days of the cancellation or the goods being returned safely (whichever is the later). You are advised to retain the packaging. You will find it difficult to return the item without appropriate packaging. The goods can not of been fitted, installed or used in any way. The goods must be unmarked and free from blemishes of any kind, and you must return them in a saleable condition. The cost of returning the item to us is the customers responsibility.
Description of Goods
All products available on this website are of a technical nature and it would be impractical for us to publish detailed technical specifications. The descriptions given are believed to be accurate to the best of our knowledge. All drawings, descriptions and specifications are merely for the purpose of providing you with approximate information about the goods before you make a purchase. We would however recommend that you check specific technical details of products with the manufacturer if in doubt.
Technical specifications and details are subject to upgrade or change at the manufacturer’s discretion. We supply products as supplied to us from the manufacturer. Marble, granite and limestone are natural products that were created in the ground over millions of years ago. It is therefore natural to expect variations in shading, veining and finish. In some materials, imperfections, “pitting” and even fossils can be apparent; these are in no way considered faults and are part of the natural beauty of marble, granite and limestone.
Recommended retail prices (RRP) quoted is based on average high street prices.
Payment and Price
The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in our supplier's prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform you of the correct price and give you the opportunity to cancel the order.
To use the Price Beater simply provide us with your name, email and telephone number and the Competitor's product link and price and we will get back to you as soon as possible. All Price Beater orders will need to be taken over the telephone with one of our friendly sales team. Please note this only works on a like to like basis the delivery times, charges and free items have to be the same and stock availability will also be taken into consideration. We cannot price match after payment has been taken.
(Please be aware that everyone makes mistakes and many website have misprints on them, sometimes we can’t possibly match a price because the information on a competitor’s site is incorrect. The Price Beater may be claimed at the time of purchase only.)
Availability of Goods
All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.
All prices on our website are inclusive of delivery charges to most UK Mainland addresses, please see exclusion in the delivery details page. Delivery is free for most UK Mainland addresses. AM/PM and Saturday deliveries are optional and will also incur additional charges. These can be obtained upon application.
We reserve the right to refuse the supply of goods at our discretion ordered by you to be delivered to any particular postcodes which incur extra charges.
Delivery of stock items will normally be made within 3-5 working days from clearance of payment. Most fires and stoves are delivered within 3-5 working days, fireplaces and electric suites are delivered within 7-14 working days. Special orders or goods made to a customer’s specification can take up to 28 working days. We will endeavour to deliver goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes outside our control. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods.
Goods will be delivered on the date chosen; delivery times are between 7am and 9pm.
If we or our suppliers are temporarily out of stock, we will notify you of this position and you should allow up to 14 days for dispatch of the goods. For delays of more than 14 days, you will have the right to cancel the order and we will refund any money paid by you for the goods.
Please note free delivery is a one man service. Please make provision to assist the delivery driver when ordering large products on a pallet or if you live in a flat where there are stairs involved to deliver to your premises. Two man delivery is available on request but will incur extra charges, please call for details.
We strongly recommend that you do not book fitters for your appliances until you have received and inspected your goods.
Delivery of Goods
As soon as we have delivered the goods to your door you will be responsible for them. We will only deliver goods to the address on the order and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods, shortages or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery.
Please note if you delay in accepting the goods, our delivery responsibility for everything other than any damage due to negligence will end on the date the carrier tried to deliver the goods to you. The carrier shall be entitled to hold the goods in storage and to charge you the reasonable costs of such storage and insurance which you will be liable to pay to them. You may also be liable for an additional delivery charge caused by these events in the re-delivery of the goods for a second time.
All gas appliances must be installed by a GAS SAFE REGISTER registered and suitably qualified gas engineer. You can find a local engineer on the GAS SAFE REGISTER website www.gassaferegister.co.uk IMPORTANT – gas fires cannot be installed by the buyer, they must be installed by a GAS SAFE REGISTER engineer.
When working with electrical appliances you should always consult an appropriate professional electrician. Always read and follow any relevant manuals and safety instructions. When working with electricity always turn off the mains supply.
We strongly recommend that you do not book fitters for your appliances until you have received and inspected your goods.
In the event a product is listed at an incorrect price due to typographical error or error in pricing information, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If you have already been charged and we subsequently cancel your order, we will immediately give you a full refund.
Time Limitation for Notification of Claims
Damage in transit: If goods arrive in a damaged condition you must make a note on the carrier's delivery consignment note and it will be your responsibility to inform us within 24 hours from delivery.
Shortages: It is your responsibility to sign for the correct number of packages as shown on the carrier's delivery consignment note. Any shortages must be noted on the consignment note and it will be your responsibility to notify us within 24 hours from delivery.
In-Correct Goods: It is your responsibility to notify us of any in-correct goods supplied within 24 hours from delivery.
Non-Deliveries: We will not accept liability for goods lost in transit unless we are notified within 7 days from the expected delivery date.
If goods returned under this clause are found to be perfect and in full working order, these will be returned to you and an administration fee of 15% of the price of the goods along with the cost of carriage will be charged to your credit card account.
Cancellation of Orders:
No Fault Returns.
You are entitled to withdraw from this contract within 7 days from delivery of the goods for a full credit or refund less any applicable delivery charges. The goods must be unopened and ‘as new’ in their original box and packaging including all manuals and accessories. You must notify us within 7 days from date of delivery and we will issue you with a Returns Authorisation Number. Returns Authorisation Number will be valid for 14 days and it will be your responsibility to return the goods to us insured via recorded delivery at your own cost and risk. Please also retain proof of insurance and posting as we will not accept any liability for goods lost or damaged in transit back to us. We will not accept any goods being returned without a valid Returns Authorisation Number clearly marked on the outside of the packaging as they will be refused on arrival.
When we receive the goods we will inspect them to ensure all manuals, accessories and other components are within the returned package and that the goods and packaging are in the condition that we sent them to you. If we receive an item that either is not in the condition we sent it or has missing components we shall charge you a further fee to cover the cost of these items.
Please note it is your responsibility to ensure that the goods you order are specified to meet your intended purpose. We therefore recommend that you independently research the goods before you purchase them from us.
Please note the right to cancel does not apply to personalised goods or goods made to a consumer's specification (special orders).
Faulty Returns – Dead on Arrival.
A product is deemed to be ‘dead on arrival’ if it shows symptoms of hardware failure preventing basic operation upon its first use out of the box. In such instances please contact our customer support helpline within 7 days from the delivery date. You can then either return the faulty item directly yourself or we will organise a collection from your home. Upon receipt of the goods and confirmation of the fault by our technical engineers you will be offered the following options:
1. A replacement – this item will be shipped to you at our own expense.
2. A repair – the repaired item will be shipped to you at our own expense. Please note that once repaired the product is no longer eligible for replacement.
3. A full refund – provided the item has been verified faulty and is complete with all accessories in its original box and packaging. If the condition of the product or the packaging is poor then we reserve the right to impose a charge to cover re-packaging costs. Missing accessories will also be charged to you.
If the product is not deemed to be faulty by our technicians then you will be offered the following options:
1. Return of the goods – the cost of delivery and an administration fee of 15% of the price of the goods will be charged to your credit card account.
2. Refund – the invoice cost less an administration fee of 15% of the price of the goods along with any applicable delivery charges provided the product is ‘as new’ and complete with all accessories in its original box and packaging. If the condition of the product or the packaging is poor then we reserve the right to impose a charge to cover re-packaging costs. Missing accessories will also be charged to you.
The manufacturers guarantee will apply to all items reported to be faulty after 7 days from delivery. Please note with all Gallery and GB Mantels products this warranty period for faulty returns has to be within 3 days of delivery of the goods, and the items have to of been signed for as received damaged on the delivery note.
This returns policy does not affect your legal rights.
